English: American army general U.S. Grant smokes with his back to the smaller tree as he makes the decision with his council to "fight it out". The decision was a costly one as it lead to the Union defeat at the Battle of Cold Harbor and more than 10,000 Union casualties. (The Photographic History is placing this photograph incorrectly. It was one of a famous series taken by Timothy O'Sullivan at Massaponax Church, near Guinea Station, on May 21, 1864, just after the Battle of Spotsylvania Court House. The Photographic History caption refers to Union "losses," which do not equal numbers killed.)
